These Terms and Conditions (“Terms”) set out the rules that govern your access to and use of SharpDay. SharpDay is a web-based productivity service operated by Krisztina Kiss, sole proprietor (egyéni vállalkozó), based in Hungary.

By creating an account, subscribing to a plan, or otherwise using SharpDay, you agree to these Terms and to our Privacy Policy. If you do not agree, you may not use the service. These Terms are governed by Hungarian law. The language of these Terms is English. Questions regarding these Terms may be directed to support@mysharpday.com.
In order to use SharpDay, you must first create an account. This can be done either by registering with an email address and password or by using Google Sign-In. During the registration process you are required to explicitly accept both these Terms and our Privacy Policy. Without this acceptance, it is not possible to create an account.
During sign-up, you are also given the option to consent to receiving marketing emails. Such consent is strictly optional and is valid only if you are 16 years of age or older. Regardless of whether marketing consent is granted, SharpDay will always send you essential communications, such as payment confirmations, security notifications, and service updates that are necessary for operating your account.
If you initially register with an email and password and later choose to log in using Google with the same email address, SharpDay will automatically link this provider to your existing account. If the addresses differ, a new account will be created. Accounts created under different addresses are not automatically merged, and any request for such a merge must be made to us via support@mysharpday.com.
You are responsible for ensuring that the information you provide is accurate and kept up to date. You must also keep your login credentials secure. Any activity carried out through your account is considered your responsibility. Sharing or transferring your account to another person is prohibited.
SharpDay is designed exclusively for individual use as a personal productivity tool. It is not intended for commercial exploitation, competitive analysis, or for building competing products. By using SharpDay, you agree not to engage in activities such as reverse engineering, decompilation, or tampering with the service. You may not interfere with its normal operation, attempt to access it in unauthorized ways, or use automation and scraping tools without our written permission. Using SharpDay in violation of applicable laws or the rights of others is not permitted.
When you create an account, you are entitled to a seven-day free trial. During this period, no payment information is required and all features of SharpDay are available without limitation. The purpose of this trial is to allow you to evaluate the service in full before making a purchasing decision.
At the conclusion of the trial, you may either subscribe to continue using paid features or remain with a non-subscribed account. If you do not subscribe, your account remains active, and your data is stored under the retention rules described in Section 9. No additional or repeat free trial is granted if you later decide to subscribe again.
SharpDay currently offers a single subscription plan, the Starter Plan, which is billed monthly. Subscriptions must be purchased as a natural person for personal use. We do not issue invoices containing tax identification numbers. Use of the app by individuals who are also part of a company or sole proprietorship is permitted, but if a subscriber demands an invoice with a tax ID, which we cannot provide, we reserve the right to cancel the subscription and prevent further purchases.
Payment for subscriptions is processed exclusively through Stripe Checkout. Once your payment has been successfully completed, access to paid features is granted immediately. Subscriptions renew automatically at the end of each billing period unless you cancel in advance through your account settings. If you cancel, your subscription remains active until the end of the paid billing cycle, after which your account returns to non-subscribed status.
Refunds are generally not offered, except where required by applicable law (for example, the 14-day EU cooling-off period).
If you reside in the European Union, you have a statutory right to withdraw from an online contract within 14 days of purchase without giving a reason. This cooling-off period begins on the day the subscription contract is concluded.
If a renewal payment attempt fails (for example, due to insufficient funds or an expired card) you will be notified by email. At that point a five-day grace period begins. During this grace period, you are expected to update your payment details and ensure that the payment is completed. On the fifth day we attempt to process the payment again. If the second attempt fails, your subscription is cancelled immediately but your data will be stored. In order to regain access, you must initiate a new subscription. A new free trial will not be granted.
If you believe a payment was made in error or have any other billing-related dispute, you must first contact support@mysharpday.com. We will attempt to resolve the issue directly. While a dispute or chargeback is pending, SharpDay reserves the right to suspend your account. After review, we may reinstate your access or permanently cancel the account, depending on the outcome of the dispute.
You may choose to reset or permanently delete your account.
SharpDay is continuously developed to improve user experience and expand features. We regularly release updates and provide changelogs detailing these changes. Features may be added, modified, or removed over time. Whenever a significant change occurs, we will notify you either within the application or by email. Continued use of the service after such changes constitutes your acceptance of them.
If you are not on an active subscription, the data you created in the SharpDay app will be retained for a period of twelve months. After this period, they will be permanently deleted. Your account itself will continue to exist with minimal identifying information, allowing you to log in and subscribe again in the future. Data that you delete yourself, whether through a reset or account deletion, is immediately and irreversibly removed.
All content, design, branding, source code, and features of SharpDay are the intellectual property of Krisztina Kiss. You are granted a personal, limited, non-transferable, non-exclusive, revocable license to use SharpDay for productivity purposes. Copying, reselling, redistributing, or exploiting the service or its components without prior written permission is strictly prohibited.
SharpDay includes original music tracks created by us using AI-assisted composition tools. All music is exclusive to SharpDay and licensed only for use within the application for personal productivity purposes.
You may create videos, reviews, tutorials, or other content that demonstrates SharpDay's features, including music playback. This is encouraged for review, educational, or promotional purposes related to SharpDay.
You may not extract, download, copy, or use the music separately from the application. You may not use the music to promote competing products or claim it as your own work. Your license to access the music terminates when your subscription ends or your account is deleted.
Unauthorized use of the music constitutes a material breach of these Terms and infringement of our intellectual property rights. We reserve the right to terminate your account immediately and pursue legal remedies, including claims for damages and injunctive relief, as well as recovery of attorney fees and costs.
SharpDay relies on third-party services for certain features, such as Google for authentication and Stripe for payment processing. These providers have their own terms of service and privacy policies, which apply to their components. While we take care to use reputable providers, we cannot accept responsibility for failures, outages, or misconduct of third-party services.
SharpDay is provided on an “as is” and “as available” basis. We do not make any promises or guarantees regarding uptime, uninterrupted service, absence of errors, or fitness of the service for your personal needs. Although we take measures to safeguard your data, we cannot guarantee that data loss will never occur.
To the fullest extent permitted by law, Krisztina Kiss and SharpDay shall not be held liable for indirect or consequential damages, including but not limited to lost productivity, missed deadlines, loss of data, account access problems, interruptions of service, or unauthorized access to your data. In all cases, our total liability is limited to the total amount you paid to SharpDay in the twelve months immediately prior to the event giving rise to the claim.
Your use of SharpDay is subject to our Privacy Policy, which explains in detail how we collect, use, and protect your personal data. The Privacy Policy also describes your rights under the GDPR.
These Terms are governed by the laws of Hungary. If you encounter any issue or dispute, you must first contact support@mysharpday.com so that we can attempt to resolve the matter. If the issue cannot be resolved through this process, the matter shall be referred exclusively to the competent courts of Hungary.
We may update these Terms from time to time. If material changes are made, we will notify you either by email or via an in-app message. Your continued use of the service after the changes take effect will signify your acceptance of the updated Terms.
